1. Acceptance of Terms

By downloading, installing, accessing, or using the Closet.ly mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and Kimbert Bartiquel ("we," "us," or "our").

2. Description of Service

Closet.ly is a digital wardrobe and outfit planning application that allows users to:

• Organize and catalog their clothing items digitally
• Create and save outfit combinations
• Plan outfits for different occasions and seasons
• Track and manage their personal style preferences
• Access wardrobe analytics and insights

3. User Accounts and Eligibility

To use certain features of Closet.ly, you may need to create an account. You must:

• Be at least 13 years of age to use this App
• Provide accurate and complete information when creating your account
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account

4. Acceptable Use

You agree to use Closet.ly only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Upload content that is illegal, harmful, threatening, abusive, or offensive
• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Attempt to gain unauthorized access to the App or its systems
• Use the App for commercial purposes without our written consent
• Upload malicious code or attempt to disrupt the App's functionality
• Share inappropriate or offensive content through the App

5. User Content and Intellectual Property

Your Content

You retain ownership of all photos, outfit combinations, and other content you upload to Closet.ly ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing our services.

Our Intellectual Property

The Closet.ly App, including its design, functionality, algorithms, and all related intellectual property, is owned by Kimbert Bartiquel. You may not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or attempt to extract the source code
• Remove or alter any proprietary notices or labels
• Use our trademarks or branding without permission

6. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Closet.ly, you consent to the collection and use of your information as described in our Privacy Policy.

7. Third-Party Services

Closet.ly uses TelemetryDesk for privacy-focused analytics and performance monitoring. TelemetryDesk's terms of service and privacy policy apply to their services. We are not responsible for the practices or policies of third-party services.

8. App Updates and Modifications

We may update Closet.ly from time to time to:

• Add new features and functionality
• Improve performance and user experience
• Fix bugs and security issues
• Ensure compatibility with new operating system versions

You agree to accept updates when offered. Continued use of the App after updates constitutes acceptance of any changes.

9. Subscription and Payment Terms

Closet.ly may offer premium features through subscription plans. If you choose to subscribe:

• Subscription fees are charged in advance and are non-refundable
• Subscriptions automatically renew unless cancelled
• You can manage your subscription through your device's app store
• Price changes will be communicated in advance
• We reserve the right to modify or discontinue subscription plans

10. Limitation of Liability

To the maximum extent permitted by law:

• Closet.ly is provided "as is" without warranties of any kind
• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the App in the past 12 months
• We are not responsible for data loss, though we encourage regular backups

11. Internet Connection and Data Usage

Certain features of Closet.ly require an internet connection. You are responsible for:

• Maintaining a stable internet connection
• Any data charges from your mobile carrier
• Understanding that some features may not work without connectivity

12. Termination

Either party may terminate this agreement at any time:

• You may stop using the App and delete it from your device
• We may suspend or terminate your access for violations of these Terms
• We may discontinue the App with reasonable notice
• Upon termination, your right to use the App ceases immediately

13. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where Kimbert Bartiquel resides. Any disputes will be resolved through binding arbitration or in the courts of competent jurisdiction.

14. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by:

• Posting updated Terms in the App
• Updating the "Last updated" date
• Providing in-app notifications for significant changes

Your continued use of Closet.ly after changes constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
